0. In-Person Courses / Courses Covered by Statutory Health Insurance
Registration for the course is binding. Participants will receive a registration confirmation via email. The contract is concluded upon confirmation by the midwife via email.
1. Billing for Postnatal Recovery Courses and Childbirth Preparation Courses
1.1 For individuals with statutory health insurance:
Course hours that have been attended and signed for will be billed by the midwife directly to the statutory health insurance fund. Remuneration is based on the currently applicable remuneration agreements for midwives according to §134a SGB V.
1.2 For privately insured individuals:
Privately insured individuals and self-payers will receive an invoice according to the Midwifery Private Fee Ordinance (Hebammen-Privatgebührenverordnung, 2.0x rate) to submit to their insurance company and must pay in advance, regardless of whether the costs are covered by the private health insurance.
1.3 Partner Fee:
For two course evenings €50 or for the second course day €80 private share, regardless of the type of insurance. Most health insurance companies now cover this share. Upon request, you will receive a corresponding certificate from me, which you can then submit. Reimbursement is not obligatory!
The partner fee for the childbirth preparation course must be paid within the specified time after receipt of the invoice. Participation without an accompanying person is, of course, possible. In this case, the partner fee is waived completely.
2. Missed Hours
2.1 Privately insured individuals
If the course participant misses individual hours or the entire course, the midwife retains her claim to fees regardless of the reasons why the participant did not attend. Therefore, missed hours will also be billed privately.
Exception for childbirth preparation courses: unplanned premature end of pregnancy (e.g., premature birth).
2.2 Course Instructor
The course instructor is entitled to cancel or abort individual course dates or the entire course due to illness or force majeure. For course hours cancelled due to illness of the course instructor, substitute dates will be offered where possible. If the substitute date is not attended, the claim to the course hour expires.
The course instructor reserves the right to cancel courses with an insufficient number of participants.
3. Right of Withdrawal / Cancellation / Refund
3.1 Cancellation Policy (Statutory Right of Withdrawal)
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of the conclusion of the contract (registration). To exercise your right of withdrawal, you must inform me (Josephine Winter-Halbeck, Birkenweg 12, 92289 Ursensollen, info@hebamme-amberg.de) by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

3.2 Cancellation of Course Registration
Independent of the statutory right of withdrawal mentioned above, a cancellation of the course registration is possible up to 4 weeks before the start of the course. The cancellation must be made in text form (e.g., email or post). The decisive factor is the receipt of the declaration of cancellation by the midwife.
4. Cancellation of Individual Course Hours
It is not possible to cancel individual course hours. Only entire courses can be cancelled.
5. Self-Pay Courses
Registration for the course is binding. Participants will receive a registration confirmation via email. The contract is concluded upon confirmation by the midwife via email. Participants will receive an invoice and must pay in advance.
5.1 Additional Regulations for Self-Pay Courses
If the number of participants is too low, the midwife reserves the right to cancel the course up to 5 days before the course begins. Cancellations by the participants up to 14 days before the course begins are possible upon payment of a €10 processing fee, after which the entire course fee is due. Costs for missed appointments by the participants cannot be refunded. Premature termination before the end of the course is not possible, regardless of the reasons. The extraordinary right of termination according to § 626 and § 627 BGB is also expressly waived. If the course instructor is unable to attend, missed appointments will be rescheduled. The course instructor is not liable for accidents and other damages that occur during the course hours and on the way to and from the venue.
It is agreed that all course hours of the corresponding course must always be booked. It is not possible to book only individual hours of a course.
During the baby courses (baby massage), the duty of supervision lies with the parents or the accompanying person.
6. Liability
6.1 Course Participation/Care
Participation in the courses is at your own risk.
6.2
The course instructor assumes no liability for wardrobe, left items, or parked strollers, etc.
The course instructor assumes no liability for damage to participants' property (e.g., glasses, mobile phones) if this is damaged during the exercises.
6.3
The midwife's liability for third-party negligence is also excluded according to § 276 and § 278 BGB.
6.4
The midwife assumes no liability for damage to health if this arises from situations that are not directly related to the exercise instructions.
Booking confirms that the participant's state of health allows participation in the booked course. The participant is obliged to provide truthful information about her health complaints and impairments. This applies in particular if these complaints are relevant to the course and its contents.
6.5
Liability is limited to intent and gross negligence.
7. Online Courses
In rare cases, it is possible that a switch from an in-person course to an online course takes place.
In this case, all other course conditions listed above remain in effect.
Cancellation due to a switch from an in-person course to an online course or vice versa is excluded.
7.1 Image/Audio Recordings
Due to the GDPR (DSGVO), image and audio recordings of the course instructor are not permitted.
7.2 Participation
The participants must themselves ensure that they have the necessary hardware and software to use the streaming offer. As far as the course is covered by the health insurance company in this form, the participant undertakes to send the necessary attendance confirmation form to the midwife within one week after the end of the course.
It is strictly prohibited for persons other than the course participant herself and the partner to participate in the course.
Participants are advised that the General Terms and Conditions and privacy policies of the streaming provider must be observed – the midwife assumes no responsibility for these.
8. Miscellaneous:
Siblings cannot be brought to the postnatal recovery course.
In all courses, the duty of supervision for one's own child/children lies with the course participant.
9. Severability Clause
Should a provision of these General Terms and Conditions be or become invalid, the validity of the General Terms and Conditions in other respects shall not be affected. The invalid provision shall be replaced by a provision that comes closest to the intention of the parties within the legally possible framework. The same applies in the event of a regulatory gap.
A separate treatment contract applies to postnatal care (Wochenbettbetreuung).
